Please read these Terms of Service carefully before using our services. By accessing or using our services, you agree to be bound by these terms.

Acceptance of Terms

By accessing or using our services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

Use of Services

Account Registration

To access certain features of our services, you may be required to create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

You must be old enough to agree to these terms where you live. Children can use Sportdify through a profile that a parent or guardian creates and manages. You can delete your account at any time in the app under Account › Delete account.

Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose
  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit any harmful, threatening, or offensive content
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of our services
  • Use automated systems to access our services without permission

Community Standards

We have zero tolerance for objectionable content and abusive users. You must not post or share content that is harassing, hateful, sexually explicit, violent, or that exploits or endangers children, and you must not bully, threaten or impersonate others.

You can report content or people from inside the app, and block anyone you don't want to hear from. We review reports promptly and may remove content and suspend or close the accounts of people who break these terms. Club owners and admins can also remove content posted in their club.

Intellectual Property

Our Content

All content, features, and functionality of our services are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of any content you submit to our services. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content in connection with our services.

Recordings and Livestreams

Clubs and people who record or livestream games with our services are responsible for having permission to do so from the players, coaches and spectators being filmed, including a parent or guardian's permission for anyone under 18, and for following their sport's and venue's rules on filming.

Improving Automated Camera Features

Unless a club turns this off in its recording settings, we may use still frames taken from game recordings uploaded to our services to develop, train and test the features that frame the action automatically, such as detecting where the ball and players are. When we do this:

  • We use the frames only to build and improve these features of our own services. We don't sell them or let others use them for their own purposes.
  • We don't use them to identify people, and we don't use facial recognition.
  • The frames stay in storage we control and are accessed only by people and service providers working on these features under confidentiality obligations.
  • A club can turn this off at any time. From then on we stop taking new frames from its recordings and remove its frames from the data we use for future training. Models already trained before then can't "unlearn" individual frames, but they don't contain the frames themselves.

Payment Terms

Fees

Some of our services require payment. You agree to pay all applicable fees as described on our website. All fees are non-refundable unless otherwise stated.

Billing

We may bill you through an online account or other methods. You authorize us to charge your chosen payment method for all applicable fees.

Payments to Clubs

Membership fees, game fees, event entries, invoices and shop orders you pay in Sportdify are paid to the club. Sportdify processes these payments through Stripe on the club's behalf. The club sets the price and decides on refunds, so contact the club first about any of these payments.

App Store and Google Play Purchases

Purchases made in the iOS or Android app, such as Player Pro, are billed by Apple or Google under their terms. Subscriptions renew automatically until you cancel them, and you manage or cancel them in your App Store or Google Play account settings. Refunds for these purchases are handled by Apple or Google.

Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including if you breach these Terms of Service.

Upon termination:

  • Your right to use our services will immediately cease
  • We may delete your account and any associated data
  • Provisions that should survive termination will remain in effect

Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

  • Our services will be uninterrupted or error-free
  • Defects will be corrected
  • Our services are free of viruses or harmful components

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits or revenue
  • Loss of data
  • Loss of goodwill
  • Business interruption

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses arising out of:

  • Your use of our services
  • Your violation of these Terms of Service
  • Your violation of any rights of another party

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of any material changes by posting the new terms on our website. Your continued use of our services after such changes constitutes acceptance of the new terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
